Terms & Conditions

These terms apply when you engage Ohma Digital for website and related digital services.

1. Services

We provide website and digital services as agreed in your proposal, quote, or written agreement.

Any free audit or review material is general information only and is not a guarantee of specific business outcomes.

2. Quotes and Scope

Quotes are valid for 30 days unless otherwise stated. If scope changes, pricing and timelines may be updated.

3. Fees and Payment

Fees are in AUD.

  • Project work usually requires a deposit before commencement
  • Remaining project fees are due before launch unless agreed otherwise
  • Monthly services are billed in advance while active
  • Late payment may result in service suspension

4. Client Responsibilities

You agree to provide timely feedback, approvals, and required content, and to ensure you have rights to materials supplied.

Delays in approvals or content may affect project timelines.

5. Revisions and Changes

Reasonable revisions are included during agreed stages. Additional work outside agreed scope may be separately quoted.

6. Intellectual Property

You retain ownership of your original content. Ownership of custom deliverables transfers to you once all related fees are paid in full.

Third-party materials remain subject to their own licences and terms.

7. Third-Party Services

Your services may involve external providers. We are not responsible for third-party outages, pricing changes, or policy changes outside our control.

8. Cancellation and Suspension

  • Project deposits are generally non-refundable once work starts
  • Monthly services may be cancelled with 30 days written notice
  • We may suspend services for non-payment or unlawful use

9. Liability

We provide services with due care and skill. To the extent permitted by law, our liability is limited to fees paid for the affected service.

Nothing in these terms excludes rights that cannot be excluded under Australian Consumer Law.

10. Governing Law

These terms are governed by the laws of South Australia, Australia. Disputes are subject to the courts of South Australia.
